Black Lung Benefits Act

Thousands of individuals make their living by working in our region’s coal mines. Unfortunately, exposure to coal dust can cause significant breathing difficulties, including Black Lung disease (pneumoconiosis). The Black Lung Benefits Act provides monthly payments to miners and their surviving dependents in cases where coal dust exposure has caused a pulmonary disability.

Regulations to the Act have created many legal presumptions in favor of miners. This has made it easier to prove entitlement to benefits. Because Black Lung is a progressive disease and might not be manifested until many years after the exposure, miners are permitted to file claims even where they have been denied in the past.
