Our attorneys help with the purchase and sale of your home or business property, including preparing the deed, reviewing the title to the property, and working with the lenders if you are getting a loan.  We work closely with both the realtors and lenders to coordinate residential and commercial real estate closings. We also represent clients with respect to leases, easements, landlord/tenant disputes, and boundary disputes.

For our business clients, we have experience with the purchase, sale or lease of housing facilities, rental apartments, convenience stores, restaurants, gas stations, and manufacturing facilities.

Buyer Closing Services– Prior to closing, our office works closely with you so that all legal documents are completed for the closing to occur on time.  We will assist in obtaining and reviewing property appraisals, in contacting local taxing authorities for verification of property taxes, in obtaining the lender documents, and in the preparation of the Closing Disclosure.

At closing, we will obtain all signatures and collect and disburse the loan proceeds and other funds.

Following the closing, we will disburse the costs and fees in accordance with the Closing Disclosure, forward the loan documentation to the lender, record the deed, mortgage and other required documents in the appropriate county offices, and issue the title insurance policy.

Seller Closing Services On behalf of a seller, we will prepare the deed and, if necessary, a power of attorney, to transfer title to the property.  We will review the Closing Disclosure to ensure that the appropriate costs and pro-rations are made on behalf of the seller. Contact Us

CTM Settlement Co. is a licensed title insurance agency in Pennsylvania of which Attorney Michael Supinka is an agent.  If you require a loan, the bank will often require title insurance.  Even if the lender does not require title insurance, you may consider purchasing an owner’s policy to protect your title to the property.  With title insurnace, you know the property you are buying is good and marketable.  The cost of title insurance is regulated by the Pennsylvania Department of Insurance and all title insurance companies must charge the same rate based on an established rate chart.

Title Searches

It is very important that you have clear title to the property that you are buying.  Clear title means that there is no right or claim that could affect your ownership or use of the property.  Those who may have a right or claim could be the Internal Revenue Service, the Pennsylvania Department of Revenue, municipal authorities, county and school taxing districts, lenders, judgment creditors, contractors, and other individuals or governmental entities.

Any rights or claims affecting the property will stay with the property and transfer to the new owner unless they are extinguished.  When purchasing property, you want to make certain that any of these title defects are identified and either accepted or extinguished prior to the sale.

A title search may reveal the existence of recorded defects or liens on the title such as unpaid taxes, unsatisfied mortgages, judgments or liens against the current or prior owners, and easements or rights-of-way across the property.

 

CTM Settlement engages a detailed and diligent search of the public records at the county courthouse to identify all recorded documents that affect the property.  We review and examine these recorded documents to determine whether there may be any rights or claims that could threaten your title or possession of the property.

If there are recorded title defects or liens, we report them to you  prior to your purchase of the property.  We then work with you to determine whether to accept or try to remove any of these recorded defects prior to closing.

*  Title Insurance

There may be hidden rights or claims that affect the title to the property that are not shown of public record and are not recorded at the county clerk’s office.  Such risks would not be seen on even the most exhaustive title search.  These risks could include forgery, incompetency, incapacity, missing heirs, or instruments executed by invalid powers of attorney.  Title insurance may be available to protect against such unrecorded risks.  The specific language of each title insurance policy must be reviewed carefully and governs what losses are covered.

CTM Settlement is licensed with the Pennsylvania Department of Insurance as a Pennsylvania agent authorized to offer both owner’s title insurance and lender’s title insurance. CTM Settlement provides title insurance through Fidelity National Title Insurance Company.
