Purchase Agreement – Realtors often use standard printed forms from the Pennsylvania Association of Realtors® (PAR). Although these forms are useful, an attorney can explain the many provisions and suggest changes or additions to protect a buyer. For example, the following are some of the issues that may need to be added or revised in a Purchase Agreement:
*Are any items included in the sale such as the stove, refrigerator or curtains?
*Is your requirement to buy contingent on you obtaining sufficient financing?
*What inspections are you able to undertake? And what are the consequences if the house does not pass an inspection?

Title Search – A title search is necessary to find out the state of the seller’s title to the property. A title search protects the buyer by ensuring that the seller has title to the property and what liens, encumbrances or restrictions are on the title. An attorney will review the title search and be able to explain if there are any mortgages, easements or other restrictions on the title that have to be removed or would interfere with the buyer’s use or ownership of the property.

Preparing the Deed – It is the seller’s responsibility to have a deed prepared transferring the property to the buyer. It is important to consult with an attorney who can prepare the deed and work with the buyer’s attorney to finalize the deed.

Closing – The date that the sale occurs and when title passes from the seller to the buyer is called the “closing”. The deed and other closing papers must be prepared prior to closing. At the closing, the purchase price is paid, often from the proceeds of a mortgage loan. A closing statement is also prepared prior to the closing indicating the debits and credits to the buyer and seller. An attorney is helpful in reviewing all these closing documents, including the deed and the closing statement, and can explain the closing costs.
